NCLAT upholds CIRP against Simbhaoli Sugars, dismisses appeals

The National Company Law Appellate Tribunal (NCLAT) pronounced its judgment on July 13, 2026, dismissing the appeal filed by promoter Ms. Gursimran Kaur Mann and disposing of the appeal filed by farmer Mr. Surender Pal Singh Mangat regarding the Corporate Insolvency Resolution Process (CIRP) of Simbhaoli Sugars Limited. The tribunal upheld the admission of the Corporate Debtor into CIRP, rejecting arguments that the proceedings were initiated solely due to the Reserve Bank of India's February 12, 2018 circular, and confirming that debt and default were conclusively established. The company remains under CIRP pursuant to an order by the National Company Law Tribunal (NCLT) dated July 11, 2024, with Mr. Anurag Goel continuing as the Interim Resolution Professional (IRP).
